The replacement pair will likely have the same issue whatever is. I had 4 pairs within 2 months. All with the same problems, some of them straight out of the box. I returned them in the end.
We can clearly say, this is probably the worst product of Bose. Sadly they don’t even care with the customers who bought their most expensive ANC flagship. Most common problems are being reported since last year June but Bose have never addressed any of those issues. Always the same robotic useless answers and no actual solution.
