I updated firmware as soon as I connected them. Unless I remain absolutely still the left ear and sometimes both cut out while walking around with phone in my pocket. Unusable when walking outside. Yes I have cleared the paired list since that seems to be the first troubleshooting suggestion. Anything else to try before I send them back?

Yes you are correct, clearing the pairing list and reconnecting the headphones via Bluetooth is the first troubleshooting step we would suggest. As there is a lot of interference outside, I would suggest to try and reset both devices.
To reboot your headset:
Place the earbuds into the charging case
Plug the charging case into a wall outlet using a USB charger and wait 5 seconds
Unplug the USB cord from the charging case and wait 1 minute
